The deal between you and Kind Post.

The short version

Kind Post is operated by Post Timely Inc., a Canadian corporation. By making a card on Kind Post you agree to these terms. We'll do our best to mail the card you wanted to the person you wanted. You agree to use Kind Post for actual cards to actual people you have a reason to contact, not for spam, harassment, or impersonation.

You're the sender. We're your messenger.

When you make a card on Kind Post, youare the sender. Post Timely Inc. acts as your agent and messenger to draft, print, and deliver the card on your behalf. The relationship is between you and your recipient. We're just the courier carrying what you wrote.

By creating a card, you authorize Post Timely Inc. to:

  • Draft card content (with AI helpers when you opt in) based on the brief you wrote
  • Print and mail the card to the recipient you chose, on your behalf
  • Deliver a digital version of the card when mail isn't possible
  • Contact your recipient on your behalf to gather information we need (like their mailing address)
  • Identify you by name in those messages, unless you chose anonymous outreach (in which case the message identifies Kind Post as the messenger and explains that a friend has sent them a card)

The card the recipient gets is from you. If the recipient ever takes issue with being contacted (they don't know who you are, they didn't want a card, they want their information removed), that's a question between you and them. Post Timely Inc. will honor opt-outs, respect STOP signals, and pass any complaints back to you.

Who can use Kind Post

You need to be at least the age of majority in your jurisdiction (typically 18 in Canada and the US, 16 in much of the EU) to make a Kind Post account. If we discover you're not, we'll close your account.

What you promise us when you send a card

By creating a card and providing recipient contact info, you confirm:

  • You have a real reason to contact this person: you know them, they expect to hear from you, or you have a legitimate relationship.
  • You won't use Kind Post to harass anyone, send threats, impersonate someone else, or contact people who've told you to stop.
  • You won't use Kind Post for commercial spam, political solicitation, or marketing to people who haven't consented.
  • The contact information you provide is accurate to the best of your knowledge.
  • You'll respect any STOP / opt-out / wrong-number signal we receive. We'll automatically suppress further sends, and you won't try to circumvent that suppression.
  • You have permission to upload any photos or content you add to a card.
  • You won't invite anyone under the age of 13 as a signer or recipient. For signers between 13 and 17, you confirm you have a parent or guardian's permission to include them. Kind Post is built for adults sending cards to people they have a real reason to contact.

We log your acceptance of these terms when you start a card, including the time, your IP address, and the version of these terms you accepted. That log is part of how we comply with Canada's CASL and the US TCPA + CAN-SPAM rules around outbound messaging.

What we'll do

  • Make the card as you described it (with our AI helping where you opted in).
  • If you provided the address, mail the card on the schedule we agreed.
  • If you asked us to collect the address privately, send your recipient an SMS or email asking for it (with you named, unless you chose anonymous outreach).
  • If we can't mail by your deadline, send a digital version instead and only charge the digital fallback amount.
  • Keep recipient address data private from you.

Your content

You keep ownership of the card content you create: the brief, the messages, the photos you upload. To make and deliver the card you asked for, you grant Post Timely Inc. a non-exclusive, royalty-free, worldwide licence to host, store, transmit, reproduce, and display that content for the limited purpose of operating Kind Post for you (drafting, rendering, printing, mailing, and digital delivery). We don't use your content for anything else, and we don't use it to train AI models.

If signers add notes to your card, the same applies to their content: they grant us the limited licence we need to display their note on the card you're sending.

Payment

By starting payment setup, you authorize Kind Post to charge:

  • A reservation deposit today (covers the digital fallback if mailing falls through)
  • The mail balance when we hand the card off to the post: $9.99 USD if you provided the address, $11.99 USD if we collected it
  • If you added a gift card, the face value plus a $3.50 USD fee, charged in USD
  • If we can't mail and send digital instead: nothing extra (the deposit covers it)

All charges are processed by Stripe. We never see your card number. If a charge fails, we'll email you to update your payment method.

Refund policy:until we've handed the card off to the post, you can cancel for a full refund of any amount charged. Once mailed, refunds aren't available; the card's already on its way.

Taxes: prices shown include any sales taxes required for your jurisdiction (Canadian GST/HST/QST is calculated at checkout). For senders outside Canada, your local tax rules may also apply.

What can go wrong

Mail is mail. Cards can be lost, delayed, or returned by the postal service. If a card we mailed is returned to sender, we'll let you know and refund the mail balance; the deposit stays with us as the digital fallback delivery.

We can't guarantee a specific delivery date once a card's in the mail system. We work with thanks.io (our print + fulfillment provider) and the postal service to give you the best timing we can.

The AI we use to draft cards isn't perfect. You get to review and edit the draft before payment, and you choose which direction to send. We're not responsible for AI output you accepted and chose to send.

Things outside our control

Kind Post depends on external systems we can't guarantee: the postal service, our print + fulfillment partner (thanks.io), payment networks, SMS and email carriers, our hosting provider, and the broader internet. If any of those are disrupted by something outside our reasonable control (postal strikes, severe weather, vendor outages, network interruption, government action, or other force-majeure events), we'll do our best to deliver your card and to communicate with you about the delay, but we're not liable for the disruption itself.

If a card can't be mailed because of an event like that, we'll route it through the digital fallback at no extra charge. If we can't do even that for an extended period, we'll cancel and refund.

If you misuse Kind Post

We can pause or close your account at any time if we believe you've violated these terms, particularly if recipients report harassment, you've sent without permission, or you're trying to circumvent STOP signals. Cards in flight when we close an account get cancelled and refunded.

The legal stuff

Limitation of liability:Kind Post is provided as-is. To the extent permitted by law, our total liability for anything related to your use of the service is limited to the total amount you've paid us in the 12 months before the issue arose. This doesn't limit any rights you have under consumer-protection laws that can't be excluded by contract.

Indemnity:if a third party sues us because of something you did with Kind Post (for example, a recipient you contacted without permission, or content you uploaded that wasn't yours), you agree to defend, indemnify, and hold harmless Post Timely Inc. and its officers, employees, and agents.

Governing law: These terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict-of-law principles. Disputes will be resolved in the courts of Alberta, except where consumer-protection laws in your jurisdiction give you a non-waivable right to bring a claim locally.

Severability: if any part of these terms is found unenforceable, the rest of the terms still apply.

Entire agreement: these terms plus the Privacy Policy are the full agreement between you and Post Timely Inc. about Kind Post.

Changes to these terms

We'll post material changes here and stamp a new effective date. For changes that affect what you authorize us to do (especially sending recipient outreach), we may require you to re-accept before your next card.
